These terms govern access to and use of Aformity websites, applications, products, and services.

These Terms of Use govern access to and use of Aformity websites, applications, products, and services. By accessing or using Aformity, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent.
Aformity operates primarily from Australia and may provide services to customers and users in Australia, the United States, and other locations. If you have a separate written agreement, order form, data processing terms, or other signed contract with Aformity, that agreement controls to the extent it conflicts with these Terms.
These Terms are written for business use of Aformity. The service is not intended for personal, household, consumer, children's, or regulated-data use unless Aformity expressly agrees otherwise in writing.
1. Eligibility and authority
You may use Aformity only if you can form a binding contract and comply with these Terms. If you use Aformity for an organization, you represent that you have authority to bind that organization.
2. Accounts and administration
You are responsible for maintaining accurate account information, safeguarding credentials, managing authorized users, and all activity that occurs under your account. You must promptly notify Aformity of any suspected unauthorized access or security issue.
3. The service
Aformity provides tools for customer data onboarding and migration work, including preparation of files, mappings, validations, transformations, review workflows, and import-ready outputs for use with third-party systems.
Aformity may modify, improve, suspend, or discontinue features from time to time. We will use commercially reasonable efforts to avoid material disruption for active customers, subject to these Terms and applicable agreements.
Aformity is a workflow and readiness layer. It does not replace customer review, destination-system testing, professional advice, legal review, compliance review, accounting review, payroll review, healthcare review, or other domain-specific approval.
4. Customer data and responsibilities
You retain ownership of data, files, schemas, instructions, configurations, and other materials you submit to Aformity. You grant Aformity the rights needed to host, process, transmit, display, and use that material to provide, support, secure, and improve the service.
You are responsible for ensuring that you have all rights, permissions, notices, and legal bases required to submit customer data to Aformity and to use outputs generated through the service.
- Review all prepared, transformed, or validated data before importing it into a destination system.
- Do not submit regulated, prohibited, or highly sensitive data unless a written agreement expressly permits that use.
- Maintain appropriate backups and source-of-truth records outside Aformity.
- Ensure that customer administrators, implementation users, and other authorized users act within the permissions granted by your organization.
- Do not submit passwords, API keys, private keys, production secrets, or unnecessary personal information.
5. Acceptable use
You must not misuse Aformity or help anyone else do so.
- Do not violate law, privacy rights, intellectual property rights, or contractual obligations.
- Do not attempt to gain unauthorized access to systems, accounts, data, or networks.
- Do not interfere with service operation, bypass usage limits, probe for vulnerabilities without authorization, or introduce malicious code.
- Do not use Aformity to create, enrich, or distribute unlawful, deceptive, harmful, or discriminatory data processing workflows.
- Do not submit data that you do not have the right to process, migrate, transform, export, or provide to Aformity.
- Do not use Aformity to make automated decisions about individuals that have legal or similarly significant effects unless expressly permitted in a written agreement and supported by your own compliance process.
6. Output review and destination systems
Aformity may generate suggested mappings, validation results, transformed records, cleanup recommendations, issue summaries, and import-ready files. These outputs are provided to support customer review and implementation work.
You are responsible for reviewing outputs before import, confirming that destination-system requirements are correct, testing imports where appropriate, and deciding whether any output is suitable for your use case.
Third-party systems may reject imports, change requirements, apply different validation rules, or behave differently from customer-provided documentation. Aformity is not responsible for the operation, availability, or data handling of third-party systems after export or transfer.
7. Fees, trials, and payment
Fees, payment terms, subscription periods, renewal terms, and cancellation rights are set out in the applicable order form, checkout flow, or written agreement. Trials, pilots, beta features, or free access may be limited, changed, or discontinued at any time unless otherwise agreed in writing.
Unless a written agreement states otherwise, fees are non-refundable except where required by law. You are responsible for taxes, duties, and similar governmental charges associated with your purchase, other than taxes based on Aformity's income.
8. Intellectual property
Aformity and its licensors retain all rights in the service, software, design, technology, documentation, and related intellectual property. Except for the limited right to use Aformity under these Terms, no rights are transferred to you.
If you provide feedback, suggestions, or ideas, Aformity may use them without restriction or obligation to you.
Aformity may develop or improve features, models, workflows, templates, documentation, and product capabilities based on aggregated learnings and operational experience, provided that Aformity does not use your confidential customer content in a way that identifies you or your customers except as permitted by agreement or law.
9. Third-party services
Aformity may interoperate with third-party applications, platforms, or data destinations. Your use of third-party services is governed by the terms and policies of those providers. Aformity is not responsible for third-party services, their availability, or their handling of data after export or transfer.
If you direct Aformity to export, transfer, or prepare data for a third-party destination, you are responsible for that destination's configuration, permissions, import behavior, and downstream use of the data.
10. Confidentiality
Each party may receive non-public information from the other party. The receiving party will use the same degree of care it uses to protect its own similar information, and no less than reasonable care, to protect confidential information and use it only for the relationship between the parties.
Confidential information does not include information that is public through no fault of the receiving party, already known without a confidentiality obligation, independently developed without use of the other party's confidential information, or lawfully received from a third party.
11. Privacy and data processing
Aformity's Privacy Policy explains how Aformity collects, uses, discloses, and protects personal information. Where Aformity processes customer content on behalf of a business customer, additional data processing terms may apply if incorporated into a written agreement.
You are responsible for providing legally required notices, obtaining consents or other legal bases, responding to data subject or consumer requests where you are the controller or business, and ensuring that your use of Aformity complies with applicable privacy and data protection law.
12. Sales and marketing communications
If you submit an email address through Aformity's website, signup flow, contact forms, demo requests, or similar forms, you agree that Aformity may use that email address to contact you about Aformity products, services, trials, demos, onboarding, updates, and related sales and marketing communications, where permitted by applicable law.
Commercial emails from Aformity will include an unsubscribe or opt-out method where required by law. You can also ask us to stop sending marketing emails by contacting hello@aformity.com. Opting out of marketing emails does not prevent Aformity from sending service-related, transactional, security, legal, or account communications.
13. Security and suspension
Aformity may take steps to protect the service, customers, users, and third parties, including investigating suspected misuse, limiting activity, removing harmful content, or suspending access where Aformity reasonably believes there is a security, legal, operational, or abuse risk.
You must promptly notify Aformity of suspected unauthorized access, credential compromise, data exposure, or security vulnerabilities affecting your account or use of the service.
14. Disclaimers
Aformity is provided on an as-is and as-available basis except as expressly stated in a written agreement. To the maximum extent permitted by law, Aformity disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Aformity does not guarantee that prepared data will be accepted by every third-party system or that every customer-specific import issue will be detected.
Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, right, or remedy that cannot be excluded, restricted, or modified under applicable law, including applicable Australian consumer law protections where they apply.
15. Limitation of liability
To the maximum extent permitted by law, Aformity will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. Aformity's aggregate liability for claims relating to the service will not exceed the amounts paid to Aformity for the service giving rise to the claim in the twelve months before the event giving rise to liability, unless a written agreement states otherwise.
16. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Aformity from claims, losses, liabilities, damages, costs, and expenses arising from your customer data, your instructions, your breach of these Terms, your misuse of the service, your violation of law or third-party rights, or your use of outputs after export or import.
17. Suspension and termination
Aformity may suspend or terminate access if you breach these Terms, create risk for the service or other users, fail to pay amounts due, or use the service in a way that may violate law or third-party rights. Upon termination, your right to use the service ends, but provisions that by their nature should survive will continue to apply.
18. Changes to these Terms
Aformity may update these Terms from time to time. If changes are material, we will provide notice through the service, website, email, or another reasonable method. Continued use after the effective date of an updated version means you accept the updated Terms.
